The plaintiff at the time of the accident decided to use a step ladder rather than a scaffold tower as he believed the tower to be unsafe. Whilst on the step ladder the plaintiff fell 10 feet to the ground, sustaining a compound fracture to his leg.

The plaintiff has had numerous operations and now needs to use a mobility car when leaving his house.
