Injured cyclist injury compensation claim due to potholes & defects

Filed under: Cyclist Compensation Claims — admin @ 10:58 am

Whilst cycling and paying attention to an oncoming car, a cyclist was injured when his front wheel fell into a hole in the road which had been left by workman.  The workmen had been putting a dropped kerb in place. They had used a cutting machine and failed to fill in the gap of around 3 inches in width away from the kerb once the kerb had been put in place.

The cyclist was thrown over his handlebars and suffered a soft tissue shoulder injury.

He took photos of the area and after seeing his doctor decided to make a no win no fee injury compensation claim.

The defect area was repaired by the company soon after his accident had been reported to them.

Any cyclist injured or motorcyclist by a defect in the road, may be able to claim compensation if they have suffered injuries which could, and should have been avoided if the correct maintenance work had been carried out by the authority responsible.

There is a three year time limit in which to claim compensation for a cycling accident. We usually find that the majority of these claims are made soon after the cycling accident.

Cycling accident due to pothole causes injury to child

Filed under: Cyclist Compensation Claims — admin @ 8:47 am

When out cycling with a friend, a boy was injured when his bike hit a pothole, causing him to be thrown over the handle bars into metal railings.

Kieran Smith, aged twelve of Exwick in Exeter, required hospital attention due to the cycling accident as it caused bruised ribs, black eyes and cut lips.

Kieran’s dad, is not happy with the council who have left the potholes unrepaired in Kinnerton Way, Exwick, Exeter, where the cycle accident happened.

He feels his son could have sustained much worse injuries from his accident.

As he hit the railings with such force, it was described his injuries looked like he had done 12 rounds in a boxing ring.

A spokeswoman from Devon County Council went to inspect the pothole which caused the cycle accident, and said ” We have been to inspect the area and do not consider the small hole to be a safety defect.”

For accidents and injuries caused by potholes, often a claim for injury compensation is made by the injured party. We can advise if a claim for tripping on a pothole, or whether a claim for an accident caused by cycling into a pothole can be made.

The cyclist suffered multiple injuries including a broken arm and wrist. The injured cyclist Luke Reedman, 28, is making a cyclist accident compensation claim for injuries. The cycling accident has meant Mr Reedman has had to take time off work and has lost wages as a result.
