Injured by a side mirror or opened car door, can I claim?

People often ask us if they are able to claim as a pedestrian who has been hit by a car, lorry, or van door being opened or by a vehicle side mirror.

It is not only pedestrians who can be injured in this way, as vehicles often collide as a result of an opened door.

However this type of accident happened, as long as it was not your own fault and you were injured, a claim for injury compensation is likely to be possible with the specialist help of the Accident Advice Bureau.

Who is liable for this type of accident depends on the actual circumstances. If two cars were involved, it is normally assumed that the individual who hit the door is at fault, as it can be argued that they were driving without car and attention, as they did not see the opened door in time to stop safely.

Having said this, the onus also sits with the driver or passenger of the vehicle to ensure that it is clear and therefore safe to open their vehicle door.

The Highway Code (section 239) states that before opening your car door you should check for cyclists other road users and pedestrians.

Can I claim for injury on a public footpath?

There are thousands of public footpaths in our villages, towns and cities. These footpaths as they are for public use should be well maintained and safe to use. Toddler involved in a road traffic accident

A little girl thought to be two or three years old was involved in a traffic accident when she got out of her pushchair and was hit by a van in the road. The girl who was thought to have been with her mum was waiting at a pedestrian crossing in St Mary’s Street Lincoln this week just before the accident happened.

The injuries suffered by the little girl are said to be non life threatening. The lorry driver near the scene, who could see what was happening, was said to have sounded the horn and tried to stop traffic, but was unable to. It was a Ford Transit which hit the toddler as it emerged from the High Street.

The police and ambulance attended the scene and took the toddler to Lincoln County Hospital. This was around 3.20 on Tuesday.

Pedestrians escape injury when glass falls from a building

In a lucky escape yesterday, there were no pedestrians injured by a falling payne of glass in a busy Sheffield city centre street. The glass fell from a height of four stories from a window frame and could have caused severe or fatal injuries to pedestrians on the street.

The glass measured two feet by three feet. The glass payne fell from a top floor window. The window frame was understood to be in a “poor condition”.

The building which is leased to Sheffield Council belongs to the developer Hammerson. The building is Palatine Chambers on Pinstone Street, near Peace Gardens.

A passerby had said “It was amazing no one was hurt, there were a lot of people around.

Following the accident, Sheffield Council day workers visited the site, and used a cherry picker, to check the other windows for public safety.

We do not know if the window just fell, through severe lack of maintenance and checking of its safety, or if it was an accident at work as someone was working or someone was just opening the window.

Pedestrian accident claim for compensation

The child pedestrian later went to see his doctor, who diagnosed severe bruising to his left ankle. He returned to his doctor approx two weeks later as he was still suffering and further diagnosed with soft tissue damage and ligament damage to his left ankle.

The boy who suffers from asperger, is now frightened to go outside as he is scarred another accident involving a car mounting a pavement may happen again.

Pedestrain hit by lorry wing mirror claims compensation

A pedestrian hit by a lorry when walking on the pavement made an injury compensation claim for the injuries suffered. The female pedestrian was walking on the pavement with a friend when a lorry wing mirror hit her in the back of the head making her fall to the ground. The lorry drove too closely to the pavement putting pedestrians in danger.

The pedestrian accident was witnessed by other pedestrians and the driver of the lorry stopped having realised what he had done. Details were taken of the lorry driver. The pedestrian went to hospital and was diagnosed with whiplash injuries to her neck and shoulders and also suffered a back injury. The injuries had a huge impact on her life and she felt a pedestrian claim for compensation would help her financially.
