Car Passenger Claim for Injury Compensation
A car accident resulting in a car passenger claim for compensation we handled, involved a girl who was sitting in the rear seat with her friend and there was another passenger in the front seat. The car she was in was being driven too fast round a corner when the driver lost control and the car came off the road. The car then went up the kerb and hit a tree, causing the car to come to a sudden stop.
The passengers in the rear were thrown in the car and our client was thrown through the windscreen and knocked unconscious as she had failed to put her seat belt on. This accident caused severe injuries to the passengers and an ambulance attended taking some of the passengers to hospital.
The police attended the scene and took statements from all involved, the car was written off.
Our client suffered cuts, whiplash and back injuries as a result of the car accident. As a seat belt was not being worn by the passenger, the compensation awarded was reduced by 25%.
The accident highlights the dangers of not wearing a seat belt and our client said she would not go in a car again without wearing the seat belt as she now realises the dangers of not wearing it.
Any passenger injured in a car accident will receive maximum compensation for injuries suffered. No reduction of compensation is made if the seat belt was worn. Car passenger claims are among the easiest to win as passengers are not at fault for the accident.
