Injured by a Car

Filed under: Road Traffic Accidents — admin @ 9:22 am

If as a driver of a vehicle or pedestrian, you have been hit by a car and been injured it could be possible to make a claim for injury compensation.

Pedestrians are sometimes hit through no fault of their own, for example, when crossing the road at a defined crossing area by a driver who is not paying attention to the road.

Other times when walking along the pavement pedestrians have been hit by the mirrors from passing vehicles. This type of accident often results in whiplash injuries to the neck.

If you have been hit by a car and injured, the police should be informed and a reference number obtained.

In order to make a claim for injury compensation, the injuries sustained must be sufficient to seek medical attention from a doctor or hospital.

Many people think that in order to make an accident claim, the injured person must be signed off work, if employed, this is not the case. If however time is taken off work as a result of the injury and money has been lost due to this, then a claim for lost wages may be submitted with the claim for injuries. As well as this a claim for other expenses such as home help if required, prescription costs, travel expenses and any other money that has been paid out as a result of the accident and injury can be claimed for.

For accident claims involving someone being hit by a car, where ever possible we will ensure that 100% of the compensation is awarded. In a few cases, where the driver is untraced or has not got insurance, a deduction of the compensation may be taken by the injury solicitor. We will always advise on this before the claim is taken on, if any deduction is to be made.

*100% compensation does not apply to untraced drivers or Criminal Injury (assault). In such accident claims a percentage of the compensation may be deducted by the solicitor.
